What is Class D Felony?

There are four classifications of felonies in Iowa, ranging from Class D to Class A felonies.

 

Class D felonies are punishable by either a suspended or imposed five year prison sentence. Some may be deferred. In the case of Operating While Intoxicated -- Third Offense charges, they may not be deferred and a minimum 30 day jail sentence must also be imposed in addition to a five year prison sentence that can be suspended. Probation in the Sixth Judicial District is typically three years but can be as little as two years.

 

Fines typically range from $1,025 to $10,245. In the case of felony Operating While Intoxicated (OWI) third or subsequent offenses, the fine range is not less than three thousand one hundred twenty-five dollars nor more than nine thousand three hundred seventy-five dollars.

 

Probation., if a sentence is suspended, is almost always supervised, at least in the Sixth Judicial District, though I have recently seen Class D felonies unsupervised in other jurisdictions. It's rare.

 

Felons lose their right to vote, for example, and a right to possess a firearm and ammunition.
